My opinion is that this is a negotiable item. It should be covered off in the functional design.
On the other hand I find it un-scrupulous to "hide" this detail from the customer (unless it contains some proprietary code on the developers part) and usually will lead to this being your last job if you try to "own" the logic built for them.
Bring it up and charge approprietly so that the "air" and repeat business are kept intact. This is the "ethical" thing to fo in my opinion.
